Welcome to www.stampitbyher.com, operated by Jeorchelae Waye owner of StampItByHER, a commissioned Notary Public in the State of Georgia. These Terms & Conditions ("Terms") govern your use of my Website and the services I offer. By accessing or using my Website and services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use my Website or services.
1. My Services
I provide professional notary public services in the State of Georgia, including but not limited to:
- Acknowledgements
- Wills/Trusts
- Signature Witnessing
- Certified Copies (subject to Georgia law as outlined below)
- Power of Attorney
- Closing/Loan Signing
- Refinance
PLEASE NOTE:
- I AM Not an Attorney: I am not a licensed attorney and do not provide legal advice, prepare legal documents, or interpret legal documents. I recommend consulting with a qualified attorney for any legal questions or concerns.
- No Remote Online Notarization (RON) in Georgia: Remote Online Notarization (RON) is not permitted for Georgia notaries. All notarial acts must be performed in person, requiring the physical presence of the signer(s) before the notary.
- Certified Copies: I can only make certified copies of documents under specific conditions mandated by Georgia law.
This includes:
- The document must be an original.
- It cannot be a public record or a publicly recorded document for which certified copies are available from an official source other than a notary.
- The document must be photocopied under our direct supervision.
- I cannot certify copies of vital records (e.g., birth certificates, marriage licenses, death certificates) or court documents.
2. Fees and Payment
- My fees for notarial acts are set in accordance with Georgia law and are as follows:
- Per notarial act: max $2 per act as per Georgia law].
- Mobile/Travel Fee: A separate travel fee may apply for services rendered outside our primary service area or for mobile notary services. This fee will be quoted and agreed upon in advance. Our standard travel fee is $25-$50 for locations within 50 miles. Distances beyond this may incur additional charges, quoted per engagement.
- All fees will be disclosed to you verbally and/or in writing prior to the performance of any notarial act.
- Payment is due at the time that BASIC NOTARIAL SERVICES are completed and within 30 days for REALTOR NOTARIAL SERVICES with respected forms received. Invoices will be sent immediately. I accept [Paypal-Invoices] and onsite payment for basic notary services.
- No fees will be charged for notarial acts that are incomplete or where we are unable to perform the notarization due to insufficient identification, incomplete documents, or refusal of service (see Section 4).
3. Client Responsibilities
To ensure a smooth and legal notarization process, clients are responsible for:
- Valid Identification: Providing current, government-issued photo identification that meets Georgia's notary requirements (e.g., driver's license, state ID card, passport, military ID). The ID must contain a photograph, signature, and physical description.
- Completeness of Documents: Ensuring that all documents are complete and ready for notarization prior to the appointment. I cannot provide advice on filling out documents.
- Understanding the Document: Confirming that all signers understand the contents of the document they are signing. I am prohibited from explaining or interpreting the contents of any document.
- Willingness to Sign: All signers must be willing to sign the document freely and voluntarily.
- Clearance: Ensuring adequate space and lighting for the notarization, especially for mobile services.
4. Refusal of Service
I reserve the right to refuse service if, in my professional judgment:
- The signer cannot provide satisfactory identification.
- The signer appears to be under duress or undue influence.
- The signer does not appear to understand the nature or contents of the document.
- The document is incomplete or appears to be fraudulent or illegal.
- The requested notarial act is beyond our authority as a Notary Public in Georgia.
- There are any concerns regarding the legality or ethical conduct of the transaction.
5. Cancellation Policy
Please allow up 2 hours if cancelling appointment.
